ABOUT THE WORKSHOP:
In the Marina Case, the California Supreme Court held that CEQA provided an independent authority
to make voluntary payments to other agencies to mitigate environmental impacts. The case is best understood
as a CEQA case affecting findings about offsite mitigation adequacy. There are significant implications for school
districts. During last year’s debates over C.A.S.H.-sponsored SB 1814, OPSC reassured districts that the SFP will fund CEQA costs.


This workshop will focus on the Marina Case issues impacting school districts, including—but not limited to—the
following:


• The responsibility and funding of offsite mitigation needs
• How to craft findings responsive to other agency claims
• CEQA mitigation options including habitat mitigation banks and Master Environmental Impact Reports
• How CEQA costs and the potentially expanded mitigation requirements of Marina can be reconciled with the
existing State School Facility Program

• How a meaningful approach that works for school districts can be achieved
