The current fiscal crisis has prompted developers to ask school districts to reduce, defer, suspend, and eliminate developer fees, and many developers are paying their fees under protest. Do they have a legal right to make such requests? What does the law allow school districts to do or not do under the current fiscal situation? How should you respond to such requests for modifications in your developer fee program and processes?

This workshop will cover the legal requirements of issues and challenges school districts are currently facing with developer fees including:

  • Brief history/background of developer fees. How did we get here and where are we going?
  • How to respond to developers’ requests for changes in your developer fees.
  • Developer’s perspective on what’s happening and what’s in their future.
  • Current and future status of Level III fees.
  • Legal requirements for preparing and updating your needs assessment.
  • Pertinent Government Code and Education Code requirements.
  • Recent actions by the State Allocation Board regarding the level of developer fees you can legally collect.

 

The afternoon portion of the workshop will cover the most significant basics of developer fees. It can serve as a primer for individuals not familiar with the laws, rules, regulations, and procedures for calculating, collecting, and using developer fees. And it will also serve as a refresher for those who have knowledge of developer fees but want to refine their knowledge and ensure that they have the most current information in this volatile fiscal and political environment.
